School Violence

Overview

True specialists who best understand the criteria applied inside the committee.

  • Extensive experience as sitting school-violence committee members: Our two managing attorneys, who serve on the School Violence Countermeasure Deliberation Committee of the district Office of Education, analyze each case together and build a tailored strategy.
  • An early response that protects the golden hour: In school violence cases, the statement given at the school's first fact-finding decides the outcome. From gathering favorable evidence to the school interview, we make sure the first step is taken correctly.
  • One-stop support from the committee through administrative, civil, and criminal proceedings: We see it through — not only responding to the committee's disposition, but also filing complaints and damages claims for recovery (for the affected student) and administrative suits contesting the disposition (for the student found responsible).
  • The child's return to normal life comes first: Beyond simply winning or losing, we advocate wholeheartedly so a hurt child can return to ordinary, healthy school life as soon as possible.

Affected students

For a victim of school violence, the most important step is securing evidence. Obtain statements from friends or acquaintances who witnessed the incident, and in cases of physical violence, go to a hospital immediately so that medical records of the current condition are preserved.

Suffering school violence is painful, but rather than filing a hasty report it is better to consult a specialized attorney first. We prepare for the committee hearing by collecting evidence for the report, drafting student and parent statements, and submitting an attorney's opinion, and where necessary we pursue further remedies such as criminal complaints or civil lawsuits.

Students accused

The same is true for the parents of the student accused. Feeling responsible for their child's conduct, they often flounder — unsure how to respond for the child's future or how to apologize to the injured party. We assist across the range: from responding to the in-school inquiry and attending the review committee to administrative appeals and administrative litigation, as well as criminal proceedings.

Our aim is not merely leniency in the proceedings, but helping the child genuinely understand what went wrong and grow into a healthy, law-abiding citizen.

The committee hearing is a critical step: a single hearing decides the disciplinary outcome for the child. Without preparation, a student facing the unfamiliar and stern atmosphere may fail to explain the facts properly or answer unexpected questions from committee members in an unfavorable way.

Seoksang Law Office prepares anticipated committee questions tailored to the student's case and runs a mock hearing that mirrors the real committee proceedings.

Our two managing attorneys, both experienced in committee hearings, and an expert with hands-on experience in education recreate the actual hearing procedure so that the client's child can present their position calmly and accurately on the day.
