Criminal cases abroad

As exchange between Korea and Vietnam has grown, many Koreans visit and stay in Vietnam for business, tourism, and other reasons. Some offenses are committed with intent or planning, but people are also drawn into criminal cases unintentionally — through simple carelessness or unfamiliarity with local laws that differ from Korea's.

Being detained in a distant country, unable to reach family while investigation and trial proceed locally, is bewildering for the person and their family alike. Through a legal cooperation MOU with the Vietnamese firm Tri Minh and a network built with Korean government offices on the ground, Seoksang provides prompt legal service in both countries.

Criminal cases in Korea

Just as many Koreans live and stay in Vietnam, a considerable number of Vietnamese nationals live in Korea. By some counts, Vietnam is the most common nationality among international students in Korea.

International prisoner transfer

International prisoner transfer allows a Korean national serving a sentence abroad, or a foreign national serving one in Korea, to be transferred home to serve it under better conditions. Korea enacted the International Transfer of Sentenced Persons Act in 2003 and joined the Council of Europe transfer convention in 2005.

Transfer requires that the conduct be an offense under domestic law, that a custodial sentence be final, and that the person consent. The requirements look simple, but many practical obstacles arise, so expert assistance matters.

International marriage and family matters

Among international marriages in Korea, unions between Korean men and Vietnamese women make up an overwhelming share. Whatever the form or nationality, a marriage is something to celebrate; yet the marriage-fraud cases and divorces following breakdown that have repeatedly made the news lately cast a shadow over the outlook for international marriage.

We assist with the legal questions involved: (1) whether grounds exist to annul or void the marriage; (2) whether grounds for divorce exist and where responsibility for the breakdown lies; (3) how to handle custody and property division on termination; and (4) whether to pursue other measures, including criminal ones.
